Intellectual Property of Artworks

 

Rights to all artworks, including originals, prints, and commissions, remain the sole property of the artist both before and after sale. Collectors may not reproduce artwork in any way without express written permission from the artist. The purchase of any item, original or otherwise, does not grant the customer permission to print, replicate or distribute the artwork in any form. Sharing photos of the purchased artworks across social media platforms does not violate this cause, as long as due reference is paid to the artist.

 

Refunds and returns

 

Care is taken to ensure colour-accurate product photographs that are as true to the original products as possible, however there is always some variation when it comes to colour calibration between devices. Colour distortion is minimised as far as is reasonably practicable, however colouring of the products received may vary slightly from those seen on the website.

 

I have a 30-day return policy, which means you have 30 from the date of purchase to request a return. To be eligible for a return, your item must be in the same condition that you received it, unused, undamaged, and in its original packaging. You’ll also need the receipt or proof of purchase.

If your return is accepted, you'll be responsible for shipping the item back to the studio. As per Australia’s consumer protection laws, shipping fees on any and all returned items within good faith are not covered by the studio.

Only in the case of faulty merchandise will the return shipping be covered by the artist.

Damages and issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item so that we can evaluate the issue and remedy it as soon as possible. I want you to love your purchase, so anything I can do to make sure that is the case is my top priority!

Exceptions / non-returnable items:

Unfortunately, I cannot accept returns on sale items, so please consider these purchases carefully.

 

Exchanges

 

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

Refunds

We will notify you once we’ve received and inspected your return, and inform you if your refund request is approved. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too. Any questions or queries regarding refund or return policies, please don’t hesitate to contact me.

 

 

Shipping Policy

 

Complementary courier services ( free courier delivery) of all original artworks is offered as part of the artwork purchase to domestic Australian addresses. All my artworks are freighted by Pack ‘N’ Send.

International collectors are required to contact me directly for shipping quotes, and I endeavor to find the most cost-effective means of transport.

The processing times of each item can be found within the product descriptions. I will endeavor to organise shipping/ courier of your purchase as soon as possible. I will keep you apprised if delays in dispatching times are foreseen, and greatly thank you for your patience in this matter. Please note that shipping time delays due to unforeseen circumstances, such a weather, with the courier may be unavoidable.

Please note that I am unable to change the address of the shipment once it has dispatched from my studio. Please contact me as soon as possible if a change of address has occurred, or an incorrect address is entered to mitigate the potential for lost goods.

Kayci Kayla Fine Art is not responsible for undelivered packages based on incorrect shipping addresses given by the customer.

 

 

Duties and taxes

The studio is operated in Queensland, Australia and is not liable for import fees on any products purchased. This includes but is not limited to the commissioning of a custom piece, originals and fine art merchandise. Any applicable taxes and duties are not included in the checkout total. These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges, so that the shipment can continue to its destination. It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to me. Provided that the product is in its original condition, I will refund you the cost of your purchase (minus the costs of shipping to your country).

 

Liability

 

Please note that I am not liable for goods once they are in the possession of the collector. Mishandling of Artwork or damages incurred after purchase will not be covered by my refund or return policy. This includes, but is not limited to : fingerprint smudging, tearing of fine art paper, damage to canvas, and damage to originals. I will not offer a refund, exchange, compensation, or replacement of any goods under these circumstances.

As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched.

 

Please read the product descriptions thoroughly and carefully. I cannot offer returns or refunds based on selecting the wrong size or change of mind. All Fine Art Prints come standard with a white border included in the dimensions specified on the product description. Original artworks are painted on gallery -wrapped canvas, and the total size of artwork is as specified.
